if they're in EU, if in EU there are a bunch of other things that might be considered problematic legally with this behavior of github's so...

I've not seen any cited legal argument that says they can't ban you under their TOS?

No, but it doesn’t matter how “banned” your are according to the service, they still have to provide all your private data upon request.
