The private company defense might become a moot point. There are numerous lawsuits now alleging these companies as state actors and some with actual receipts showing direct government communication and result action.

And just last week we have the white house essentially openly confirming state involvement.

Arguably, any entity that submits articles of incorporation to any jurisdiction is an extension of the that jurisdiction.
