In many states, it's perfectly legal if it's a private sale, ie., the seller isn't a licensed dealer. It's often dubbed the "gun show loophole", despite not being limited to sales at gun shows.

It's called the "gun show loophole" even though it has nothing to do with gun shows at all. If a licensed dealer sells at a gun show, s/he still has to perform the same background checks as if it was in-store.
