Harvard has a really straightforward contingency plan if it loses this case. SEAS will have undergraduates, it will have one kind of admissions, and FAS will have another. Students in both colleges will have some kind of pro-forma differences. The total size of FAS and SEAS-as-undergraduate will be about 50 more students than the current Harvard College alone.
That's it, now you can admit into SEAS all the students who felt they were wronged by the current criteria. The racial composition of the admits across both colleges will be very similar.
