the presumption of competence on the part of the USPTO leads to the conclusion that the two patents cover different things.

Someone needs to challenge thi stuff in court. "Presumption of competence" is a very funny phrase applied to the USPTO.

It's just as (in)accurate applied to the courts unfortunately.
