No, he is not implying that.

  P = APICopyrightable
  Q = APICopied # infringingly
Trial is trying to evaluate "P and Q". Judge does not want to evaluate "P" (lazy evaluation?), so he rewrote expression to "Q and P" hoping to short-circuit.
