He is likely hoping the courts change course if he brings up safety and terrorism. He may not be wrong as the Supreme Court has changed longstanding decisions on larger topics recently.

You have a point. The current SCOTUS majority is only paying attention to stare decisis/precedent when it's convenient for their agenda
