In fact, under the doctrine of felony murder, anyone comitting a felony during the act in which someone died can be charged with felony murder, so prosecutors are considering charging everyone in the entire attack that committed any felony with felony murder. So there may be hundreds eventually charged with felony murder from the attack - all were complicit under the law.
