Technically you're spot on and I up-voted your comment -
But something feels sour about that headline to me, it's finger pointing at an individual which smokescreens the fact that the same agency / laws / etc are still in place that allowed for the abuse to happen to begin with.

The allegations were initially based on a classified document the government accidentally mailed to the former Al-Haramain Islamic Foundation lawyers.
The classified document saw the light of day by accident. There was also a whistle blower for the Folsom St. wiretap, where in 2003 AT&T granted the NSA complete access to all voice and data communications going through the building at 611 Folsom Street in San Francisco. http://libertyalabama.com/loeverate/posts/23-AT-T-Whistleblo...
I can only wonder how much we haven't found out about.

Bush is not involved in the lawsuit. He simply authorized the program. The title makes it sound as if he is personally affected by the decision.
Slashdot and perhaps Digg etc. are more appropriate forums for discussing such topics.
Just IMHO...

This isn't democrat vs. republican, this is about citizen vs. gov't.
